Terms and Conditions
This User Agreement (“Agreement” or “Terms and Conditions”) is a contract between you (“you,” “your” or “user”) and BitSave a private limited company incorporated in England and Wales (“BitSave,” “we”, “us” or “our”) and applies to your use of the BitSave website and all services described herein (collectively, the “BitSave Services”). By registering to use BitSave through the BitSave website located at www.BitSave.io, the BitSave API, and/or any associated BitSave-hosted websites or mobile applications (collectively the “BitSave Site”), you hereby consent to be bound by the terms of this Agreement, the Privacy Policy, and the AML & CTF Policy (“Policies”) (available at: https://www.bitsave.io/privacy-policy/), incorporated herein by reference. If you do not agree to any of the terms of this Agreement or the Policies, you may not access or use the BitSave Services or any part thereof. If certain features of the BitSave Services are subject to additional terms, provisions or guidelines, they are incorporated herein by reference.

We may amend or modify this Agreement by posting on the BitSave Site or emailing to you the revised Agreement. Any revised Agreement shall be effective immediately upon your express approval, or one month after the date of posting except where the changes and modifications are required by law or on the instruction of a competent governmental agency. By continuing to access or use the BitSave Services once the revised Agreement is effective, you agree to be bound by the Agreement. We may (a) modify or discontinue any portion of the BitSave Services and (b) suspend or terminate your access to the BitSave Services, at any time, and from time to time, without notice to you in certain, limited circumstances described herein. You agree that we shall not be liable to you or any third party for any modification or termination of the BitSave Services, or suspension or termination of your access to the BitSave Services, except to the extent otherwise expressly set forth herein.

To be eligible to use the BitSave Services, you must be at least 18 years old (or the applicable age of majority and contractual capacity). By accessing or using the BitSave Services you represent and warrant that you are 18 or older. BitSave recognizes that decentralized and distributed digital currency and payment systems in which payments are processed and secured by advanced cryptography and distributed computing power instead of a central bank, corporation or government pose a risk of illegal uses (as do all financial systems). BitSave believes, however, that the legitimate use of math-based currency networks provides untold benefits and efficiencies within the global economy. Accordingly, BitSave has implemented this Agreement and its accompanying Policies to assess the specific risks posed by BitSave’s innovative services and establishes specific controls to address those risks as required by law (this Agreement and its accompanying Policies apply whether a state’s law treats bitcoin as a currency or commodity).

PLEASE NOTE THE RISKS TO CONSUMERS POSED BY BITCOIN
The risk of loss in trading or holding bitcoin can be substantial. You should therefore be aware of the associated risks and carefully consider whether trading or holding bitcoin is suitable for you in light of your financial condition.

  1. Access Conditions
    1. Password Security and Keeping Your Contact Information Current. You are responsible for maintaining adequate security and control of any and all IDs, passwords, hints, or any other codes that you use to access the BitSave Services. Any loss or compromise of the foregoing information and/or your personal information may result in unauthorized access to your BitSave Account. We assume no responsibility for any loss that you may sustain due to compromise of your sensitive information. Immediately contact BitSave Support at support@BitSave.io of any unauthorized use of your account or any other breach of security.
    2. You may not use your BitSave Account to engage in the following categories of activity (“Prohibited Use”). By opening a BitSave Account, you confirm that you will not use your Account to do any of the following:

      Violate or assist any party in violating any law, statute, ordinance, regulation, or any rule of any self-regulatory or similar organization of which you are or are required to be a member (for example, those laws, rules, or regulations governing financial services, controlled substances, or consumer protections); Partake in a transaction which involves the proceeds of any unlawful activity;
      Defraud or attempt to defraud BitSave or other BSave users;
      Infringe upon BitSave’s or any third party’s copyright, patent, trademark, or intellectual property rights;
      Provide false, inaccurate, or misleading information;
      Take any action that imposes an unreasonable or disproportionately large load on our infrastructure, or detrimentally interfere with, intercept, or expropriate any system, data, or information;
      Interfere with another individual’s or entity’s access to or use of any of the BitSave Services;
      Defame, abuse, harass, stalk, threaten, or otherwise violate or infringe the legal rights (such as, but not limited to, rights of privacy, publicity and intellectual property) of others;
      Transmit or upload any material to the BitSave Site that contains viruses, Trojan horses, worms, or any other harmful or deleterious programs;
      Harvest or otherwise collect information from the BitSave Site about others, including without limitation email addresses, without proper consent;
      Act as a payment intermediary or aggregator or otherwise resell any of the BitSave Services, unless expressly authorized by BitSave in writing;
      Transfer any rights granted to you under this Agreement;
      Use the BitSave Account information of another party to access or use the BitSave Site, except in the case of specific Merchants and/or applications which are specifically authorized by a user to access such user’s BitSave Account and information;
      Otherwise attempt to gain unauthorized access to the BitSave Site, other BitSave Accounts, computer systems or networks connected to the BitSave Site, through password mining or any other means; or
      Engage in transactions involving items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the law.
    3. The following categories of businesses, business practices, and sale items are barred from BitSave Services (“Prohibited Businesses”). By opening a BitSave Account, you confirm that you will not use BitSave Services to accept payments in connection with the following businesses, activities, practices, or items:

      Operating as an unlicensed money transmitter, money service, payment service provider, e-money, or any other financial services business which requires licensure, including but not limited to exchanges of virtual currencies, sales of money orders or traveler’s checks, and escrow services
      Gambling, except where permitted by BitSave
      Sports forecasting or odds making
      Violent acts towards self or others, or activities or items that encourage, promote, facilitate or instruct others regarding the same
      Funding any of the items included on this Prohibited Businesses list
      Any business that violates any law, statute, ordinance or regulation
    4. Use of the Service may be subject to limitations, including but not limited to transaction volumes and the number of calls permitted to be made against BitSave’s application programming interface. Any such limitations will be advised.
    5. For the purpose of account security, BitSave reserves the right to request additional information at any time to support the verification of user identities.
    6. BitSave reserves the right to lock or close accounts with no notice deemed as duplicate.
  2. Intellectual Property Rights
    1. All copyright, trademarks and other intellectual property rights in all material or content supplied as part of the BitSave Site shall remain at all times vested in BitSave. You are permitted to use this material or content only as expressly authorized in writing by BitSave and may not agree nor assist or facilitate any third party to copy, reproduce, transmit, distribute, commercially exploit or create derivative works of such material or content. If you obtain BitSave’s prior written consent, you may use and display BitSave’s name and logo (“BitSave Marks”) solely to attribute BitSave.
  3. Anti-Money Laundering (“AML”) and Counter Terrorist Financing (“CTF”)
    1. These specific AML & CTF Terms and Conditions apply to BitSave Services. They are additional to and should be read together with the Anti-Money Laundering (“AML”) and Counter Terrorist Financing (“CTF”) Policy for BitSave Services. If there is any inconsistency between them, these Specific Terms and Conditions take precedence over the BitSave AML & CTF Policy to the extent of the inconsistency.
    2. BitSave is prohibited from transacting with individuals, companies and countries that are on prescribed Sanctions lists. BitSave will therefore screen against United Nations, European Union, UK Treasury and US Office of Foreign Assets Control (OFAC) sanctions lists in all jurisdictions in which we operate. In addition, BitSave reserves the right to perform due diligence checks against the identification and verification of its users.
    3. BitSave reserves the right to withhold or delay the withdrawal of funds belonging to users who fail to comply.
    4. BitSave reserves the right to file Suspicious Activity Reports (SAR) in confidentiality to relevant government agencies.
  4. Privacy Policy
    1. Please refer to the BitSave Privacy Policy, which forms part of these terms.
  5. Electronic Records
    1. By using the BitSave Services, you agree that BitSave may provide you with any notices or other communications about your BitSave Account and the BitSave Services electronically: (a) via email (in each case to the address that you provide), text message, or (b) by posting to the BitSave Site. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
    2. From time to time, BitSave may engage third parties to assist BitSave in providing certain aspects of the BitSave Services (each, a “Service Provider”). Service Providers may include, but are not limited to; BitSave’s banking partners and technology or engineering service providers.
  6. Warranties and Representations
    1. You acknowledge that:

      You are authorized to access and use the Website;
      If you are using the Website on behalf of or for the benefit of any organization then it is assumed that you have the right to do so. The organization will be liable for your actions including any breach of these Terms;
      Your use of the Website and the Service is at your own risk. You agree that BitSave is not liable for any damage, loss or harm arising out of your use of the Website and Service;
  7. Service Performance
    1. BitSave gives no warranty about the Website. Without limiting the foregoing, BitSave does not warrant that the Service will meet your specific requirements.
    2. BitSave does not warrant that the use of the Website will be uninterrupted or error free. Among other things, the operation and availability of the systems used for accessing the Website, computer networks and the Internet, can be unpredictable and may from time to time interfere with or prevent access to the Website. BitSave is not in any way responsible for any such interference that prevents your access or use of the Website and the Service. BitSave does not warrant that the Service will be timely, secure, or virus-free, and the results that may be obtained from the user of the Service will be accurate or reliable.
  8. Profit Participation
    1. A variable interest payment is paid on the funds deposited in your BitSave account. Scheduled interest payment may be a single (1) bit. The variable interest is dependent upon several factors, including, but not limited to, the amount of funds deposited in your BitSave account, the duration of deposit, and the loan margin market rate.
    2. Interest payments can only be made by direct deposit to the BitSave account holder’s self designated bitcoin address.
    3. Interest will be applied to your account on a daily basis, in arrears, at a set time each day.
    4. You may request a withdrawal at any time if the amount requested is within your BitSave account balance and is more than 0.0005 BTC. Withdrawals can only be made to the BitSave account holder’s self designated Bitcoin address. Withdrawals are processed instantly, but sometimes in several batches during any 24 hour period.
  9. Indemnification
    1. To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless BitSave, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of the Website and/or Services; (ii) your violation of any term of these Terms of Service; or (iii) your violation of any third party right. This defense and indemnification obligation will survive these Terms of Service and your use of the Service.
  10. Limitation of Liability
    1. In no event will BitSave, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) or interruption of use or loss or corruption of data. BitSave shall have no liability for any failure or delay due to matters beyond its reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
  11. Termination & Remedies for Breach of these Terms by You
    1. If you violate any portion of this Agreement, your permission to access and use the BitSave Services may be terminated pursuant to this Agreement. In addition, we reserve the right to all remedies available at law and in equity for any such violation. “BitSave.io”, “BitSave”, and all logos related to the BitSave Services or displayed on the BitSave Site are either trademarks or registered marks of BitSave or its licensors.
    2. We reserve the right at all times to monitor, review, retain and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request. We reserve the right to cancel and/or suspend your BitSave Account immediately and without notice if we determine, in our sole discretion, that your Account is associated with a Prohibited Use and/or a Prohibited Business or in any such circumstances as BitSave, in its sole discretion, considers reasonably necessary or appropriate.
  12. Absence of Waiver
    1. Any failure or delay by us to enforce any of the Terms and Conditions or to exercise any right under the Terms and Conditions will not be construed as a waiver to any extent of our rights.
  13. Force Majeure
    1. We and our affiliates will not be liable for any delay or failure to perform any obligation under this Agreement and shall not affect the validity and enforceability of any remaining provisions where the delay or failure results from any cause beyond our reasonable control, including acts of God, labor disputes or other industrial disturbances, systemic electrical, telecommunications, or other utility failures, earthquake, storms or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.
  14. Survival
    1. All provisions of this Agreement which by their nature extend beyond the expiration or termination of this Agreement, including, without limitation, sections pertaining to suspension or termination, BitSave Account cancellation, debts owed to BitSave, general use of the BitSave Site, disputes with BitSave, and general provisions, shall survive the termination or expiration of this Agreement.
  15. Governing Law
    1. This Agreement and any matter arising from or in connection with it shall be governed and construed in accordance with the law of England and Wales. Each party irrevocably agrees to submit to the exclusive jurisdiction of the English courts over any claim or matter arising from or in connection with this Agreement. Each party agrees that the service of process in any such action or proceeding may be affected in accordance with section 15.2 of this Agreement.
Privacy Policy
BitSave (“BitSave,” “we,” “us,” and “our”) has created the following Privacy Policy to inform the user (“user,” “you,” “your,” and “yours”) of how and why we collect what information. This Privacy Policy explains the data collection and use practices of BitSave. By using our service, you consent to the data practices described in this statement. We may periodically post changes to this Privacy Policy on this page, and it is your responsibility to review this Privacy Policy frequently and we encourage you to visit this page often. From time to time, we may notify you of changes to this Privacy Policy.

WHICH INFORMATION DO WE COLLECT?

Spam is unsolicited email, also known as junk mail (received via email), or UCE (Unsolicited Commercial Email). Virtually all of us have opened the inbox of an email account and found emails from an unknown sender.
